1. Introduction
1.1. In order to deliver our services and to give you the best possible experience whilst using the Site, we will need to collect and process some of your Personal Information. In doing so, we are committed to safeguarding your privacy and the security of your Personal Information.

1.2. You are not required to provide any Personal Information on the public areas of this Site. However, you may choose to do so by completing order forms and contact forms on the Site, including to make contact in respect of any questions you may have about this privacy notice (“Notice”).

2.2. This Notice sets out the essential details relating to the Personal Information that we process about you whilst using the Site. The terms governing your use of the Site are defined in our Terms and Conditions of Use (the “Terms and Conditions of Use”).

2.4. By agreeing to this Notice, you agree to us Processing your Personal Information for the purposes set out in this Notice, in accordance with the terms of this Notice and applicable laws, including POPIA.

3. Definitions
3.1. “MissLong” “we” “us” means MissLong (Pty) Ltd, with registration No:2023/228864/07, being a company incorporated and carrying on business in accordance with the company laws of South Africa;

3.2. “Personal Information” means ‘personal information’ as that term is defined in POPIA, being:
information relating to an identifiable, living, natural person, and where it is applicable, an identifiable, existing juristic person, including, but not limited to:
(a) information relating to the race, gender, sex, pregnancy, marital status, national, ethnic or social origin, colour, sexual orientation, age, physical or mental health, well-being, disability, religion, conscience, belief, culture, language and birth of the person;
(b) information relating to the education or the medical, financial, criminal or employment history of the person;
(c) any identifying number, symbol, e-mail address, physical address, telephone number, location information, online identifier or other particular assignment to the person;
(d) the biometric information of the person;
(e) the personal opinions, views or preferences of the person;
(f) correspondence sent by the person that is implicitly or explicitly of a private or confidential nature or further correspondence that would reveal the contents of the original correspondence;
(g) the views or opinions of another individual about the person; and
(h) the name of the person if it appears with other personal information relating to the person or if the disclosure of the name itself would reveal information about the person;

3.3. “POPIA” means the Protection of Personal Information Act 4 or 2013, as amended;

3.4. “Processing” means ‘processing’ as that term is defined in POPIA, being:
any operation or activity or any set of operations, whether or not by automatic means, concerning personal information, including—
(a) the collection, receipt, recording, organisation, collation, storage, updating or modification, retrieval, alteration, consultation or use;
(b) dissemination by means of transmission, distribution or making available in any other form; or
(c) merging, linking, as well as restriction, degradation, erasure or destruction of information;

3.5. “Website” means the website of Byte Orbit currently hosted at Byteorbit.com, as Byte Orbit may choose to use from time to time; and

3.6. “You” or “User” means any person who accesses and uses the Site for any reason.

4. Information we process
We may collect or process the following types of information (including Personal Information) about you. The specific information we collect about you will vary depending on how you interact with us.

  • Contact information and personal identifiers, such as your name, address, email address, telephone number, and username or social media handle.

6. Purpose for which Your Personal Information is collected
We may use the information (including Personal Information) we have about you:

  • For legal and security purposes, such as to detect, prevent, and prosecute harmful, fraudulent, or illegal activity, loss prevention, identify and repair bugs on our Site, and to comply with applicable legal requirements, relevant industry standards and our policies.
  • For statistical purposes, where the Electronic Communications and Transactions Act 25 of 2002, permits us to use Personal Information collected to compile profiles for statistical purposes. No information contained in the profiles or statistics will be able to be linked to any specific user.
  • We also may use your information in other ways, for which we provide specific notice at the time of collection.

7. Our legal basis for processing Personal Information
We will only use the Personal Information you provide for the above purposes if:

  • it is necessary to perform a contract to which you are party (e.g., to process your payment and fulfil your order;
  • we have obtained your consent (e.g., for marketing communications);
  • we have a legitimate interest in doing so (including a legitimate interest in performing marketing activities, research activities, data analytics, internal administration functions, or for fraud prevention purposes and conducting our business in compliance with relevant industry standards and our policies); or

We may share your personal information with:

  • Our Brands –
    When you interact with a brand on our Site (“Brand”), we may share your Personal Information with the Brands. That Brand may use your personal information for marketing and advertising and other purposes identified in this Privacy Policy.
  • Service providers –
    We may transfer Personal Information to service providers who perform services on our behalf based on our instructions. We do not authorise these service providers to use or disclose the information except as necessary to perform services on our behalf or comply with legal requirements. Examples of these service providers include entities that process credit card payments, fulfil orders, and that provide website and application functionality, hosting, analytics, advertising and marketing services.
  • Corporate transactions –
    We also reserve the right to transfer Personal Information we have about you in the event we sell or transfer all or a portion of our business or assets (including in the event of a merger, acquisition, joint venture, reorganisation, dissolution, or liquidation).

9.1. object to the processing of your Personal Information at any time, on reasonable grounds, unless the processing is required by law;
9.2. withdraw your consent for us to process your Personal Information at any time; and
9.3. request that we correct, destroy or delete any of your Personal Information that we have processed in accordance with this Notice.

10. Retention and deletion of Your Personal Information
10.1. We will not retain Your Personal Information longer than is necessary to achieve the purpose for which the information was initially collected, or subsequently Processed unless we are required to do so by law.
10.2. If you request, we will delete or anonymise your Personal Information so that it no longer identifies You, unless we are legally allowed or required to maintain certain personal data, including situations such as the following:
10.2.1. where we are required to retain the Personal Information for our legal, tax, audit, and accounting obligations, we will retain the necessary Personal Information for the period required by applicable law; and/or,
10.2.2. where necessary for our legitimate business interests such as fraud prevention or to maintain the legitimacy of the products and services offered by us.

11. Anonymous data collection
11.1. We may use tools to collect information about the use of the Site. The technology is not able to identify individual users but allows us to collect usage statistics.
11.2. We may utilise temporary or session cookies to keep track of Your browsing habits. A cookie is a small file that is placed on your hard drive to keep a record of your interaction with the Site and facilitate user convenience.
11.3. Cookies will not be used to identify users personally but may be used to compile anonymised statistics relating to use of services or to provide us with feedback on the performance of the Site.

13. Transfer of Your Personal Information out of South Africa
We may subcontract the hosting of data (including Your Personal Information) to third parties located in countries other than South Africa. We will, in these cases, ensure that standard contractual clauses are agreed upon with these parties so as to ensure protection of your Personal Information.

14.1. We cannot control or be held responsible for the privacy practices of any third party websites to which hyperlinks may have been provided.
14.2. If you click on a third-party hyperlink please understand that you are leaving the Site and any Personal Information you provide will not be covered by this Notice. We strongly recommend that you review the privacy policy of any website you visit before using it further.

15. Personal Information of Children
15.1. We do not knowingly collect Personal Information from persons under 18 years. If you are under the age of 18 years, please do not use the Site, and do not provide any Personal Information to us.
15.2. If you are a parent of a child under the of 18 years and become aware that your child has provided personal data to us, please contact us using the information provided in the “Enquiries” section of this Notice, and you may request exercise of your applicable rights detailed in the ‘Your Rights’’ section 9 of this Notice.
15.3. If we learn that we have collected the Personal Information of a child under the age of 18 years, we will take reasonable steps to delete the Personal Information.
